Article 1: Length of stay<\/span>
The tenant, as the party booking this tenancy for a minimum period of 6 nights, may not<\/span>
under no circumstances may they claim any right to remain on the premises at the end of their stay.<\/span>
Article 2: Conclusion of the reservation<\/span>
The booking becomes final once the tenant has paid the full amount of the rent. A<\/span>
A deposit of 30% is payable at the time of booking; a second deposit of 30% is payable 60 days in advance<\/span>
the deposit and the balance for 40% are payable 30 days before arrival. Should this schedule not be adhered to, the<\/span>
The landlord may re-let the property, in which case any deposits paid will be forfeited.<\/span>
For any booking made less than 30 days before arrival, full payment of the<\/span>
A deposit is required.<\/span>
Regarding the flats in Alpe d\u2019Huez:<\/span>
If both flats are rented by the same tenant in Tomtorlwand: For bookings<\/span>
At Tomorrowland, the terms and conditions stipulate a deposit of 30% at the time of booking, with a second deposit of 30% to be paid<\/span>
Payment is due 6 months before arrival, and the balance of 40% is payable 60 days before your arrival. If the payment schedule<\/span>
If this condition is not met, the landlord is entitled to re-let the property and, as a result, the tenant<\/span>
will forfeit the deposits paid.<\/span>
The tenancy agreement may not, under any circumstances, be for the benefit of third parties, unless the landlord has given his written consent. Any<\/span>
A breach of this clause may result in the termination of the tenancy, for which the tenant shall be solely liable, the<\/span>
payments made which remain the property of the owner.<\/span>
Article 3: Cancellation of the rental by the hirer<\/span>
In the event of cancellation :<\/span>
- loss of deposit of 30 % for cancellations made more than 60 days before the arrival date<\/span>
- loss of deposit of 60 % for cancellations made more than 30 days before the arrival date<\/span>
- full loss for cancellations made less than 30 days before the date of arrival<\/span>
Cancellation insurance :<\/span>
Sea and Mountain Pleasure offers insurance through Chapka Assurances covering cancellation,<\/span>
interruption of stay and damage to property. The terms and conditions are set out in the policy<\/span>
insurance.<\/span>
To benefit from this insurance :<\/span>
1. Notify us immediately to ensure that the option is online at the time of booking.<\/span>
2. Report the claim online at http:\/\/www.chapkadirect.fr\/sinistre within 5 days.<\/span>
The cost of insurance is 3.7% of the total rental amount.<\/span>
Article 4: Cancellation by the owner<\/span>
The owner may cancel the booking in the following cases:<\/span>
- Previous dispute with the tenant.<\/span>
\u2013 Inappropriate, insulting or disrespectful behaviour on the part of the tenant, failing to comply with the terms and conditions<\/span>
General Terms and Conditions of Hire.<\/span>
- Non-compliance with payment deadlines.<\/span>
In all other cases, the sums paid will be refunded in full.<\/span>
Article 5: Security deposit<\/span>
A security deposit of \u20ac2,500 (via a credit card authorisation) will be taken 48 hours before arrival.<\/span>
It will not be debited and will be automatically released one week after departure.<\/span>
For the Alpe One flat and the Villa Vue Mer 180, the footprint is \u20ac1,500.<\/span>
Failure to comply with this condition will result in cancellation of the contract and loss of the deposit.<\/span>
In the event of damage, the corresponding amount will be invoiced.<\/span>
Article 6: Inventory of fixtures<\/span>
A visual inventory is drawn up and signed on arrival and on departure by the tenant and the landlord or their<\/span>
representative. It shall be the sole point of reference in the event of a dispute. Should the tenant notice a<\/span>
If there is a fault, please contact the property management company within a few hours of moving in.<\/span>
Article 7: End-of-stay cleaning and household linen<\/span>
Concierge fees are included in the rental price. They cover check-in and check-out, including the<\/span>
a concierge service, as well as end-of-stay cleaning.<\/span>
Before leaving, the tenant must carry out a basic tidying-up:<\/span>
\u2022 Empty the bins and dispose of the rubbish<\/span>
\u2022 Put the furniture back in its place<\/span>
\u2022 Empty the dishwasher<\/span>
\u2022 Wipe the surfaces with a sponge<\/span>
\u2022 Switch off the lights and the air conditioning<\/span>
\u2022 Collect the dirty laundry in the utility room<\/span>
\u2022 \u201cStress-free departure\u201d option: \u20ac90<\/span>
As the end-of-stay cleaning is included, this option means you do not have to worry about tidying up before the<\/span>
Before you leave (take out the rubbish, empty the dishwasher and gather up the household linen).<\/span>
Bed linen is available as an optional extra. It includes beds made up on arrival, towels, and<\/span>
bath mats and tea towels.<\/span>
Article 8: Arrival<\/span>
The tenant must arrive on the agreed day and at the agreed time. The property management company will get in touch<\/span>
to organise the welcome.<\/span>
You may only move into the property once the rent has been paid in full, the security deposit has been cleared and<\/span>
compliance with the compulsory housekeeping regulations.<\/span>
If the stay is cut short, no refund will be made.<\/span>
Article 9: Use of the premises<\/span>
The hirer undertakes to use the premises peacefully and to respect the facilities:<\/span>
Villas by the sea:<\/span>
Toilets: please do not dispose of tampons, sanitary towels, wet wipes or any other unsuitable items<\/span>
in the toilets. Bin bins are provided. Please could you pass on this<\/span>
A message to all holidaymakers.<\/span>
- Swimming pool :<\/span>
\u2013 Don\u2019t touch anything \u2013 it\u2019s all automated. If you have young children who can\u2019t swim,<\/span>
Keep an eye on them and make sure you close the shutter properly after use.<\/span>
\u2013 Always leave the robot in the pool; under no circumstances should you remove it from the pool, as this<\/span>
could damage the pump.<\/span>
\u2013 Check that there is enough water in the swimming pool; the water level should be halfway up the<\/span>
skimmers, so as not to damage the pump and the flap.<\/span>
\u2013 Swimming pool cover: a side-mounted key to open and close the electric cover. To close it, hold<\/span>
the key for security reasons. It is essential that there be two adults present to check the<\/span>
Ensure the shutter opens and closes properly to prevent it from jamming.<\/span>
Please ensure that the swimming pool is closed every evening after the last use in order to maintain the<\/span>
water temperature, except during heatwaves.<\/span>
\u2013 Follow the safety rules: keep a constant eye on children; do not<\/span>
diving or running around the swimming pool; no glass objects nearby.<\/span>
For Villa Mer \u2013 \u00cele de R\u00e9 only:<\/span>
\u2022 Dogs are strictly prohibited in the swimming pool. This is to avoid any risk of the liner being torn, which<\/span>
would render the swimming pool unusable; any incident resulting from failure to comply with this ban will result in the<\/span>
the tenant is responsible for the full cost of repairing and replacing the liner, as well as<\/span>
only the consequences arising from the closure of the swimming pool.<\/span>
- Plancha: must be cleaned after use (\u20ac40 supplement if not cleaned).<\/span>
- Umbrellas: close them in case of wind, put away cushions in case of rain.<\/span>
Mountain flats :<\/span>
\u2013 Jacuzzi\/Spa: you must shower before use; add bromine after each use. Close afterwards<\/span>
every time it is used, in order to maintain the water temperature.<\/span>
- Sauna: shower compulsory before use, switch off after use.<\/span>
To ensure the safety of people and the protection of property, all entrance doors must<\/span>
must be kept locked at all times during your stay. This rule is essential to ensure<\/span>
the security of the entrance hall shared by both flats, which is fitted with an opening detector.<\/span>
For the 12-sleeper flat, the ski storage room must also be kept closed and locked at all times<\/span>
using the latch provided for this purpose.<\/span>
At the entrance there is a cloakroom area where you can hang up your clothes, and we<\/span>
We would also ask you to take off your shoes, as the private staircase leading to the flat is carpeted, so<\/span>
to prioritise your comfort.<\/span>
Article 10: Charging electric vehicles<\/span>
Villas La Madrague, La Front de Mer, Le Lodge and Villa Mer (without dedicated terminal)<\/span>
Please note that these properties are neither authorised nor equipped for vehicle charging<\/span>
electrical.<\/span>
However, in exceptional circumstances and at your own risk, it is possible to use a socket<\/span>
electric.<\/span>
This usage results in a flat-rate contribution towards electricity costs set at \u20ac70 per week and<\/span>
per vehicle.<\/span>
The company accepts no liability for any damage to the vehicle, the battery or the equipment<\/span>
recharging or the electrical installations associated with this use.<\/span>
Villa Vue Mer La Californie & Villa Vue Mer 180 (dedicated charging point installed)<\/span>
These villas are now fitted with a private electric vehicle charging point, enabling charging<\/span>
secure parking for your vehicle.<\/span>
\u2022 Charging point power: 7 kW<\/span>
\u2022 Recharge option: \u20ac70 per week per vehicle<\/span>
\u2022 The company accepts no liability for any damage to the vehicle, the battery or the equipment<\/span>
charging points or the electrical installations associated with this use.<\/span>
Article 11 \u2013 Equipment breakdowns and malfunctions:<\/span>
In the event of a breakdown or malfunction of any equipment provided in the property (such as<\/span>
(e.g. dishwasher, oven, fridge, air conditioning, television, internet router, etc.), the landlord undertakes to<\/span>
to take all necessary steps to organise a response and attempt to restore the proper<\/span>
to be operational within a reasonable timeframe.<\/span>
However, as holiday lettings cannot be regarded as a hotel service, the liability of the<\/span>
The landlord shall not be held liable in the event that immediate repairs are not possible or there is a delay in carrying out the work<\/span>
due to a service provider or the temporary unavailability of a device.<\/span>
The tenant may not claim any compensation, reduction or refund in respect of these<\/span>
inconveniences, provided that the landlord has taken the necessary steps to try to resolve the problem within the<\/span>
as soon as possible.<\/span>
Article 12: Protection against theft<\/span>
Close all openings when you are away and at night, to ensure the safety of people and<\/span>
belongings. Home insurance does not cover your personal belongings and effects.<\/span>
Article 13: Capacity<\/span>
The booking is made for a specific number of guests. Any excess will result in the cancellation of<\/span>
the rental and the loss of the sums paid.<\/span>
Article 14: No smoking<\/span>
All our properties are non-smoking. When outside, please ensure you stub out your cigarette ends carefully to avoid<\/span>
any risk of fire.<\/span>
Article 15: Animals<\/span>
Pets are only permitted with the owner\u2019s prior consent and subject to a<\/span>
A surcharge of \u20ac100 per pet per stay. Any damage will be charged.<\/span>
Article 16: Insurance<\/span>
The tenant is liable for any damage caused and must be covered by insurance<\/span>
holiday cover, which is usually included in one\u2019s home insurance.<\/span>
Article 17: Timetables<\/span>
Check-in is from 5.00 pm (earlier or later depending on availability or the service provided)<\/span>
(additional charge via the concierge service).<\/span>
Departure must take place by 9.00 am at the latest.<\/span>
Depending on the time of year, an exemption until 10.00 may be granted upon prior request.<\/span>
During busy periods, concierge services may offer early check-ins<\/span>
or late departures, depending on their schedules and availability. These options must be requested and<\/span>
validated before arrival.<\/span>
\ud83d\udc49 In the event of failure to adhere to the departure time, a fixed surcharge of \u20ac100 per hour of<\/span>
A late arrival charge may apply, unless prior special arrangements have been made with the concierge service.<\/span>
Any departure after 12 noon may be charged as an additional night.<\/span>
Should the tenant refuse to vacate the premises, the property management company and the landlord reserve the right to take action<\/span>
the immediate evacuation of the property, accompanied, where necessary, by a bailiff\u2019s report and a<\/span>
full charge for the additional day, plus accommodation and\/or late arrival charges<\/span>
caused to the following holidaymakers.<\/span>
These charges will be deducted from the security deposit without prior notice.<\/span>
Article 18: Intrusion detection system \u2013 Deactivation on your arrival<\/span>
The villa is fitted with an external security system designed to detect any intrusion at the<\/span>
at the level of the front door.<\/span>
This system is switched off completely when the villa is occupied and is only active when the villa is<\/span>
unoccupied.<\/span>
Article 19: Natural environment \u2013 Possible presence of marine and terrestrial animals<\/span>
As our villas are situated by the sea or in the heart of the countryside, the local ecosystem may occasionally<\/span>
bring animals such as neighbourhood cats, small rodents or other wild animals to<\/span>
to approach people\u2019s homes.<\/span>
We would like to point out that :<\/span>
\u2022 Our villas are either brand new or regularly refurbished, and are maintained to the highest standards<\/span>
cleanliness standards, and are thoroughly cleaned by professionals before each guest\u2019s arrival.<\/span>
\u2022 The occasional appearance of animals has absolutely no connection with the hygiene or maintenance of the<\/span>
housing.<\/span>
\u2022 These visits may only take place when the bay windows, doors or windows<\/span>
are left open, or when food is left out in the open, which naturally attracts the<\/span>
local wildlife.<\/span>
The tenant therefore undertakes to :<\/span>
\u2022 Keep the openings closed when he is not there,<\/span>
\u2022 Do not leave food lying about,<\/span>
\u2022 Behaviour designed to prevent animals from entering the premises.<\/span>
No compensation may be claimed for the natural and exceptional presence of animals<\/span>
